By creating an account, signing in, or using the Real Victors mobile app or realvictors.com website (together, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you don't agree, you cannot use the Service.
Real Victors (“Real Victors”, “we”, “us”, “our”) is a basketball-focused community app operated from Ottawa, Ontario, Canada.
Real Victors is an adults-only Service. You must be at least 18 years old to download, register for, or use Real Victors. If you are under 18, you may not use the Service for any purpose. Please do not download or install the app.
You are responsible for everything that happens under your account. If you suspect unauthorized access, change your password and contact us at hello@realvictors.comimmediately. We may suspend or terminate accounts that show signs of compromise, fraud, or shared use.
Real Victors is a platform that helps players find pickup basketball games, organize exhibition matches, build teams, and track activity. Real Victors is not a party to any game you join or host. We do not own, supervise, control, or endorse the games posted on the Service unless explicitly stated. Real Victors is not a sports league, not a tournament operator, and not a venue.
If you create or host a game on Real Victors, you alone are responsible for the game. Specifically, the host is solely responsible for the venue (including any required permits, bookings, or court rentals), the players they accept, the rules they set, the way the game is run, and any fees they collect or refund.
Hosts are solely responsible for their interactions with other players and for any claims, injuries, illnesses, damages, liabilities, or costs suffered by a player in connection with any game they host. Real Victors is not a co-host, not an organizer, and not an agent of the host. Real Victors is not responsible for the conduct of any host or any player.
By hosting on Real Victors, you also agree to:

We may, at our sole discretion, warn, restrict features for, suspend, or permanently terminate any account that violates these standards. See §13.
To enforce these standards, Real Victors uses a combination of automated content-safety tools and human review. Every image you attempt to upload is scanned by Google Cloud Vision's SafeSearch service before it can be stored on the platform; uploads that the scan classifies as adult, violent, or otherwise unsafe are rejected automatically and recorded in a private admin-only audit log for review. Repeat or severe violations may result in account suspension or termination under §13. The technical details of this moderation pipeline, including the third-party processors involved and how long flagged content is retained, are described in our Privacy Policy.
You retain ownership of the content you post on Real Victors (profile photos, game write-ups, ratings, reviews, messages, uploaded images, etc.).
By posting content, you grant Real Victors a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, cache, reproduce, modify (for technical purposes such as resizing or format conversion), display, distribute, and use that content for the purposes of operating, improving, and promoting the Service. This includes using your content in Real Victors marketing materials (for example, social posts, promotional emails, App Store screenshots) provided we do not falsely suggest endorsement.
You can revoke this licence for any specific piece of content by deleting it from the Service, except for copies retained in routine backups and copies needed to comply with legal obligations or to resolve disputes.
You represent that you have the rights necessary to post the content you upload and that it does not violate anyone's rights or any law. You are responsible for any content posted from your account.
Real Victors may let players rate or review hosts and other players after a game. We do not currently support reviews of venues, and we do not act on venue complaints submitted as reviews — venue concerns belong to the venue itself. Ratings and reviews must reflect your honest experience at the game. Don't fabricate reviews, harass other players through reviews, or trade reviews for favours.
Reviews are not the right tool for reporting misconduct. If another player or a host has acted abusively, broken the rules, or made the game unsafe, use the in-app Report user function or email us at hello@realvictors.com so the situation can be handled properly. Using a public review as a substitute for a report — for example, leaving a 1-star review to retaliate against a player — is itself a violation of these Terms and may lead to removal of the review or account action. We may remove reviews that violate these standards and we may suspend accounts that repeatedly post dishonest or abusive reviews.
Basketball is a contact sport with real, foreseeable risk of injury. By using Real Victors, you acknowledge and accept the inherent risks of participating in basketball, including but not limited to sprains, fractures, concussions, dental injuries, and other injuries arising from physical contact, falls, equipment, or venue conditions.
You are solely responsible for assessing your own physical condition before playing, for the venue you choose to play at, and for the players you choose to play with. Real Victors is not responsible for injuries, property damage, illness, or disputes that occur during games arranged through the Service.
To the maximum extent permitted by applicable law, you expressly agree to release and hold harmless Real Victors and its founders, officers, employees, contractors, and affiliates from any and all claims, demands, losses, damages, or causes of action of any kind that arise out of or in connection with your participation in any game arranged through the Service, your interaction with any host or player, your visit to any venue, or any other use of the Service. You agree not to sue the released parties for any such claim, except where applicable law does not permit such a release.
Real Victors is free to download and use. The core features — finding games, hosting free pickup games, joining matches, building teams, messaging, and ratings — cost nothing. Hosts may optionally enable paid games (pickup or exhibition); when they do, the fees and rules below apply to that transaction.
For paid pickup games, the host sets an entry fee that each joining player pays. For paid exhibition matches, the host sets a per-team fee that the accepting team's owner or admin pays once on behalf of their team. At checkout, players see the entry fee plus a small Real Victors service fee, a payment-processing fee, and any applicable sales tax — the total a player owes is shown clearly before they confirm.
Real Victors operates a marketplace, not a free-of-charge directory. On each paid game we collect:
Real Victors uses Stripe Connect Express. When a player pays, the full amount lands on the Real Victors platform balance. We hold it for approximately 24 hours after the game starts. After that window, we transfer the host's share — the entry fee minus the platform commission — to the host's connected Stripe account. Stripe then runs its own settlement cycle (typically 2–7 business days for new accounts) before depositing the host's share to the host's bank account.
Game cancelled by the host: every player who paid receives an automatic full refund of the amount they paid (entry fee + service fee + processing fee), issued to the card on file. Refunds typically reach the cardholder's statement in 5–10 business days, depending on the issuing bank.
Player leaves a game more than 24 hours before start: full refund.
Player leaves a game less than 24 hours before start: the payment is non-refundable. This protects hosts who have already committed to court rentals or capacity decisions based on the player count. The app shows this rule before a player confirms a paid join and again before they leave inside the 24-hour window.
Game-day disputes (no-shows, behaviour, court conditions): contact us at hello@realvictors.com. We will investigate and may issue discretionary refunds where appropriate.
If you dispute a charge directly with your card issuer, Stripe will notify Real Victors. We may contact you and the host to gather evidence and respond to the dispute. Chargebacks filed in bad faith — for example, claiming “service not received” after fully attending a game — may result in suspension of your account and recovery of associated chargeback fees from your future activity.
Hosts who enable paid games agree to:
For each paid transaction, Real Victors is the merchant of record on the card statement (statement descriptor “REAL VICTORS”). Card-network rules, refund obligations, and chargeback handling flow through Real Victors with Stripe as our payment processor.
Real Victors can only protect payments that flow through the in-app Stripe checkout. Any money exchanged for a game outside the app — cash, e-transfer, Venmo, PayPal, friend-to-friend bank transfer, or any other off-platform method — is entirely at your own risk.
If you pay a host directly outside of Real Victors and the game is cancelled, the host disappears, or the game isn't what was advertised, we have no power to refund you, no power to issue a chargeback through Stripe, and no leverage over the host's connected payout account (because no money ever flowed through it for that transaction). We will of course try to help where reasonable — for example, by removing the host from the platform under §13 if they have a pattern of scamming players — but we cannot recover funds we never held.
For the same reason, hosts who insist that players pay off-platform are in violation of these Terms even if no fraud occurs: they bypass the payment protections, the platform commission, the receipts and tax records, and the dispute-resolution path that exists for a reason. Hosts who repeatedly route paid games off-platform may be suspended or have their connected Stripe accounts paused under §13.
Refund and cancellation expectations are set by the host. As a baseline, you and the host should resolve refund requests directly. Real Victors does not guarantee refunds for Event Fees and is not obligated to provide a refund or recourse for any Event or transaction.
If a host cancels a game and refuses to refund a paid player, or if a host repeatedly fails to deliver the game described, Real Victors may, at our sole discretion, intervene to facilitate a resolution, including by issuing a refund, debiting the host's account, or suspending the host. We are not obligated to do so and any intervention is provided as a courtesy, not a contractual entitlement.
Chargebacks initiated for legitimately delivered games are a violation of these Terms and grounds for account termination.
You may delete your account at any time from Settings → Delete Account.
Real Victors reserves the right to suspend, restrict, or permanently terminate any account at our sole discretion, with or without notice, for any reason we consider reasonable, including but not limited to: violation of these Terms or our Community Guidelines, suspected fraud or chargeback abuse, harassment of other users, repeated no-shows, abuse of refunds, providing a false date of birth or being under the 18+ age requirement, attempting to circumvent a previous account suspension, or behaviour that exposes Real Victors or other users to legal, safety, or reputational risk.
Fraud, scams, and abuse of the payments system. If we reasonably believe that a host or a player has used Real Victors to commit fraud, run a scam (including but not limited to listing fake games to collect entry fees, abusing refund flows, fabricating no-show claims, chargeback abuse, money laundering, or coordinated price manipulation), we may, in addition to suspending or terminating the account:
These measures are protective, not punitive — they exist so that ordinary players don't end up out-of-pocket because a bad actor abused the platform. We will explain the reason for an account action as soon as practical and provide a path to appeal except where investigation confidentiality, safety, or legal obligation prevents it.
Sections that by their nature should survive termination, including ownership, content licence grants, disclaimers, assumption of risk and release (§10), limitation of liability, indemnification, and dispute resolution, survive any termination of these Terms.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of any information. We work hard to keep Real Victors running and reliable, but we don't promise it will always be available, error-free, or free of bugs.
Real Victors does not verify the identity, claims, ratings, or behaviour of other users beyond basic platform-level checks (including Stripe-led identity verification for hosts). You are responsible for exercising your own judgment when interacting with other players, joining games, or visiting venues.
To the maximum extent permitted by applicable law, Real Victors and its founders, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of the Service or your inability to use the Service.
In jurisdictions that do not allow these limitations, our total cumulative liability to you for any and all claims relating to the Service is limited to the greater of (a) the amount you paid Real Victors in the twelve (12) months before the claim arose, or (b) one hundred Canadian dollars (CAD $100).
You agree to indemnify and hold harmless Real Victors and its founders, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable lawyers' fees) arising from (a) your use of the Service, (b) your content, (c) your breach of these Terms, (d) any game you host or join, or (e) your violation of any law or third-party right.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the courts located in Ottawa, Ontario, and you consent to the personal jurisdiction of those courts.
If you live somewhere where this clause is not enforceable, the dispute will be resolved in the courts that mandatorily have jurisdiction where you live.
If you downloaded Real Victors from the Apple App Store or Google Play, you acknowledge that these Terms are between you and Real Victors, not Apple or Google. Apple and Google have no obligation to provide support or warranty services for the app. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms from time to time. Material changes will be communicated through an in-app notice or email at least 14 days before they take effect, where practical. Continued use of the Service after changes go into effect constitutes acceptance.
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, along with our Privacy Policy, our Community Guidelines, and any in-app pricing or feature disclosures, are the entire agreement between you and Real Victors regarding the Service.
